NH FARMINGTON — Farmington Zoning Board splits 2-2, denying major subdivision variance for Apex Land Solutions. Applicant Ryan Heath sought relief from Agricultural Residential zone requirements on a 139-acre property to build 80 residential lots far smaller than the 3-acre minimum, with 22.5 acres of commercial land and 29.5 acres in permanent conservation. The board voted 3-1 to approve the public-interest criterion and 4-0 on property-value protection but deadlocked 2-2 on three critical tests: spirit of ordinance, substantial justice, and unnecessary hardship.
Public opposition from abutters raised concerns about wellhead protection, stormwater runoff, traffic impacts, and mapping inaccuracies. The 2-2 tie resulted in denial.
